Alcohol Ignition Interlock Basics

An alcohol ignition interlock is an in-car breath alcohol screening instrument that prevents a vehicle from starting if it detects a driver's blood alcohol concentration (BAC) over a pre-set limit. Using the same alcohol sensing technology used by police in roadside screening, the alcohol interlock is designed to fit inside the vehicle, near the driver's seat, and is connected directly to the vehicle's ignition system.

How it works

Before starting the vehicle, the driver must blow into the interlock before the vehicle can be started. Once the interlock has determined the driver is below a preset BAC, the vehicle may be started. To prevent other people from providing the required breath sample, the interlock requires additional breath samples at random intervals while the engine is running.

DUI Law In Florida

In Florida, only certain DUI's are subject to having the ignition interlock device as a punishment.   These situations include certain offenders with prior DUI offenses, those over a 1.5 Blood Alcohol Content (BAC), and those who had a minor child in the vehicle at the time of arrest.  Florida Statute 316.193 sets forth the penalties for Florida DUI's, while Florida Statute 316.1937 deals more with the ignition interlock device itself.  The inclusion of the ignition interlock device can be summarized as follows:

  • For a 1st. DUI, those with a BAC level of 0.15 and higher, or, if driving with a minor in the vehicle at the time of offense, will be required to have a ignition interlock device installed.

  • For a 2nd. DUI, all offenders are required to have the ignition interlock devise installed for at least one year.  If the driver's BAC level was 0.15, or higher, at the time of the arrest, or a minor is present in the vehicle, and it is a second DUI conviction, then the device shall be installed for at least two years.

  • For a 3rd. DUI, all DUI offenders are required to have an ignition interlock device installed for at least two years.

Costs For The Ignition Interlock Device

The cost (plus tax) to the convicted person for an ignition interlock device is:

  • $12 Interlock fee
  • $70 for installation
  • $67.50 for monthly monitoring and calibration
  • $100 refundable deposit or a $5 monthly insurance charge

Caution: Unlawful Acts Involving an Ignition Interlock Device

Florida Law specifically makes it a separate crime to:

  • tamper with, or to circumvent the operation of, a court-ordered ignition interlock device.
  • have any person whose driving privilege is restricted pursuant to this section, to request or solicit any other person to blow into an ignition interlock device or to start a motor vehicle equipped with the device for the purpose of providing the person so restricted with an operable motor vehicle.
  • blow into an ignition interlock device or to start a motor vehicle equipped with the device for the purpose of providing an operable motor vehicle to a person whose driving privilege is restricted pursuant to this section.
  • knowingly lease or lend a motor vehicle to a person who has had his or her driving privilege restricted as provided in this section, unless the vehicle is equipped with a functioning, certified, ignition interlock device.  Any person whose driving privilege is restricted under a condition of probation requiring an ignition interlock device shall notify any other person who leases or loans a motor vehicle to him or her of such driving restriction.

South Florida Locations for Installation of Ignition Interlock Device

For DUI arrests in Martin County, St. Lucie County, or Indian River County, there are no centrally located centers in Stuart or Port St. Lucie to have the ignition interlock device installed.  DUI Attorney David Golden has long lobbied Interlock Systems of Florida to create a location more conveniently located for residents of the Treasure Coast, but to date, no such location exists.  Below are the only south Florida locations presently:
